General Terms and Conditions

1. **Scope**
For all orders made through our online shop by consumers and entrepreneurs, the following General Terms and Conditions (GTC) apply.

A consumer is any natural person who enters into a legal transaction for purposes that predominantly are outside their trade, business, or profession. An entrepreneur is a natural or legal person or a partnership with legal capacity, who acts in the exercise of their trade, business, or profession when concluding a legal transaction.

These GTC also apply to future business relations with entrepreneurs, without the need for us to refer to them again. If the entrepreneur uses conflicting or supplementary General Terms and Conditions, their validity is hereby rejected; they only become part of the contract if we have expressly agreed to them.

2. **Contractual Partner, Formation of Contract**
The purchase contract is concluded with Spitzer & Helmle GmbH.

By placing products in the online shop, we make a binding offer to conclude a contract for these items. You can initially place our products in the shopping cart without obligation and correct your entries at any time before submitting your binding order by using the correction aids provided and explained in the order process. The contract is concluded by clicking the order button to accept the offer for the goods in the shopping cart. You will receive a confirmation email immediately after sending the order.

3. **Contract Language, Storage of Contract Text**
The languages available for contract conclusion are German and English.

We save the contract text and send you the order data and our GTC by email. You can view the GTC at any time here on this page. For security reasons, your past orders are no longer accessible via the Internet.

4. **Delivery Conditions**
In addition to the product prices indicated, shipping costs may apply. You can find out more about shipping costs in the offers.

We only deliver by dispatch. Unfortunately, it is not possible to pick up the goods yourself.

We do not deliver to packing stations.

5. **Payment**
In our shop, the following payment methods are generally available:

- **Credit Card**
With the submission of the order, you also transmit your credit card details to us. After your identification as a legitimate cardholder, we request your credit card company to initiate the payment transaction immediately after the order. The payment transaction is automatically carried out by the credit card company, and your card is charged.
An additional 0 percent of the purchase price is charged as costs.

- **PayPal**
During the ordering process, you will be redirected to the website of the online provider PayPal. To be able to pay the invoice amount via PayPal, you must be registered there or register first, validate your access data, and confirm the payment instructions to us. After placing the order in the shop, we request PayPal to initiate the payment transaction. Further instructions will be given during the ordering process. The payment transaction is automatically carried out by PayPal immediately afterwards.
PayPal: An additional 0 percent of the purchase price is charged as costs.

6. **Retention of Title**
The goods remain our property until full payment is made.
For entrepreneurs, the following applies in addition: We retain ownership of the goods until all claims from an ongoing business relationship have been fully settled. You may resell the reserved goods in the ordinary course of business; all arising claims against third parties from this resale are assigned to us in advance in the amount of the invoice, and we accept this assignment. You remain authorized to collect the claims, but we may also collect claims ourselves as long as you do not meet your payment obligations.

7. **Warranty and Guarantees**
Unless expressly agreed otherwise below, the statutory warranty rights apply. For consumers, the limitation period for warranty claims for used items is one year from delivery of the goods.
For entrepreneurs, the limitation period for warranty claims is one year from the transfer of risk; the statutory limitation periods for the recourse claim under § 478 BGB remain unaffected.
For entrepreneurs, only our own information and the manufacturer's product descriptions included in the contract are considered an agreement on the quality of the goods; we assume no liability for public statements by the manufacturer or other advertising statements.
If the delivered item is defective, we provide a warranty to entrepreneurs, at our discretion, by rectifying the defect (repair) or by delivering a defect-free item (replacement).
The above limitations and shortened time limits do not apply to claims based on damages caused by us, our legal representatives, or agents

- in case of injury to life, body, or health
- in case of intentional or grossly negligent breach of duty and deceit
- in case of breach of essential contractual obligations, the fulfillment of which enables the proper execution of the contract in the first place and on the compliance of which the contractual partner may regularly rely (cardinal obligations)
- within the framework of a guarantee promise, if agreed
- as far as the scope of the Product Liability Act is open.
